Terms of Service

1Acceptance of terms

By downloading, installing, or using ServiceDeco ("the App"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the App.

These Terms form a legally binding agreement between you and Perpetio OÜ, a company registered in Estonia (registry code: [registration number]). The App is distributed through the Apple App Store, and your use is also subject to Apple's Terms of Service.

2Description of the service

ServiceDeco is a mobile application for iOS that helps scuba divers track maintenance and service intervals for their dive equipment. The App enables users to:

• Record gear items and configure service rules (by date, by dive count, or whichever comes first)
• Log service events and maintain a service history per item
• Log dive entries and automatically advance per-gear dive counts
• Receive local notifications when service is approaching or overdue
• Export all data to CSV format

The App operates entirely on-device. It does not connect to any server, require account registration, or transmit your data to third parties.

3Safety disclaimer — please read carefully

By using the App, you acknowledge and agree that:

• You are solely responsible for verifying that your dive equipment meets all applicable legal inspection requirements in your jurisdiction before use. Regulatory requirements for tank inspection, VIP dates, hydrostatic testing, and regulator service intervals vary by country and change over time.
• Default interval presets provided in the App (such as VIP annual intervals and hydrostatic testing periods) are provided as a convenience only. They do not constitute legal advice and may not reflect current requirements in your specific jurisdiction.
• The App does not replace a qualified dive equipment technician, certified inspector, or authorised service centre. All physical inspection and service must be performed by qualified professionals.
• Dive counts tracked by the App reflect only dives you manually log using the App's dive log feature. The App cannot verify actual usage and is not connected to your dive computer.
• You must never rely on the App alone to determine whether equipment is safe to use. Physical inspection by a qualified technician is always required before diving with any equipment whose safety is in question.

Perpetio OÜ expressly disclaims all liability for injury, death, equipment failure, or any other harm arising from your use of or reliance on the App's tracking, reminders, or information.

4License to use the app

Subject to your compliance with these Terms, Perpetio OÜ grants you a limited, non-exclusive, non-transferable, revocable license to download and use ServiceDeco on iOS devices you own or control, for your personal, non-commercial purposes.

You may not:

• Copy, modify, or distribute the App or any part of it
• Reverse-engineer, decompile, or attempt to extract the source code
• Sublicense, sell, or commercially exploit the App
• Remove or alter any proprietary notices or labels

This license does not transfer any ownership or intellectual property rights. All rights not expressly granted are reserved by Perpetio OÜ.

5Purchases and refunds

ServiceDeco may offer a free tier and a one-time paid purchase ("ServiceDeco Pro") unlocking additional features. All purchases are processed exclusively by Apple through the App Store.

• Prices are displayed in the App Store in your local currency and include applicable taxes.
• One-time purchases are non-recurring. You will not be charged again for the same purchase.
• Refunds are handled by Apple in accordance with Apple's refund policies. Perpetio OÜ cannot issue refunds directly. To request a refund, visit reportaproblem.apple.com.
• Restore purchases: If you reinstall the App or install it on a new device, use the "Restore Purchases" option to unlock previously purchased features at no additional charge.

6Your content and data

You own all data you create in the App. This includes gear records, service history, dive logs, photos, and any other information you enter. Perpetio OÜ makes no claim to your content.

Because data is stored entirely on your device:

• You are responsible for maintaining your own backups (e.g., via iOS iCloud Backup)
• We are not able to recover data lost due to device failure, app deletion, or iOS data loss events
• You may export your data to CSV at any time using the App's export function

You represent that any data you enter does not violate any applicable law or third-party rights.

7Prohibited uses

You agree not to use the App to:

• Violate any applicable law or regulation
• Impersonate any person or entity
• Attempt to gain unauthorised access to any system, network, or data
• Interfere with or disrupt the integrity of the App
• Use the App for any commercial service bureau or time-sharing arrangement without our written consent
• Submit false or misleading service records that could affect the safety of yourself or others

8Intellectual property

The App, including its design, code, user interface, graphics, and content (excluding your data), is owned by Perpetio OÜ and protected by copyright, trademark, and other intellectual property laws.

The "ServiceDeco" name, the wave logo, and all related marks are trademarks of Perpetio OÜ. You may not use these marks without our prior written consent.

Third-party libraries and frameworks used in the App are subject to their own licenses. A complete list of open-source attributions is available within the App under Settings → About → Open Source.

9Disclaimers and limitation of liability

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Perpetio OÜ does not warrant that the App will be uninterrupted, error-free, or secure; that defects will be corrected; or that the results of using the App will meet your requirements.

To the maximum extent permitted by applicable law, Perpetio OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or personal injury — arising from or in connection with your use of the App, even if advised of the possibility of such damages.

Our total liability to you for any claim shall not exceed the amount you paid for the App, or €10 if you have not made any purchase. Some jurisdictions do not allow these limitations — in those jurisdictions, our liability is limited to the greatest extent permitted by law.

10Indemnification

You agree to defend, indemnify, and hold harmless Perpetio OÜ and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, or liabilities arising from:

• Your use of or access to the App
• Your violation of these Terms
• Your violation of any third-party right, including intellectual property rights
• Any claim that your use of the App caused damage to a third party

11Modifications to the app or terms

We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We will not be liable to you for any modification, suspension, or discontinuation.

We may revise these Terms from time to time. When we do, the "last updated" date will be updated. For material changes, we will provide notice via an in-app notification. Your continued use of the App after the effective date constitutes acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the App and may delete it from your device.

12Termination

These Terms are effective until terminated. Your rights under these Terms will terminate automatically and without notice if you fail to comply with any provision. Sections 3, 8, 9, 10, and 13 survive termination.

You may terminate these Terms at any time by deleting the App from all your devices.

13Governing law and disputes

These Terms are governed by the laws of Estonia, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia.

If you are a consumer located in the European Union, you may also benefit from mandatory provisions of the law of your EU member state, and may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
